fraud vs. misrepresentation (R.2d §§ 159–164)

Both require a false assertion of fact that induced justifiable reliance; fraud adds that the maker knew or believed it false and intended to induce (§ 162(1)); innocent or negligent misrepresentation suffices if the assertion was material (§ 162(2)). Either makes the contract voidable (§ 164); fraud in the execution makes it void.

fraude frente a misrepresentation (R.2d §§ 159–164)
