mitigation (avoidability, R.2d § 350)

Damages are not recoverable for loss the injured party could have avoided without undue risk, burden or humiliation: stop work after a repudiation (Luten Bridge), take comparable substitute employment (Parker), cover by buying substitute goods (UCC § 2-712); the breaching party bears the burden of proving the failure to mitigate.

ExamplesEjemplos

  • Building the bridge after the county cancelled added nothing recoverable.
