notice of acceptance

Acceptance by promise must be communicated with reasonable diligence; acceptance by performance needs no notice unless the offeree has reason to know the offeror will not learn of it promptly (R.2d §§ 54, 56). The offeror may dispense with notice or prescribe its form (International Filter); an uncommunicated intention is never an acceptance (White).

ExamplesEjemplos

  • Buying lumber in your own shop told the offerors nothing; a note saying I accept would have.
