Email to the supervising attorney: the memo's bottom lineCorreo a la abogada supervisora: la conclusión del memo

Assignment

Your supervising attorney, Dana Okafor, is in depositions all day and will read your message on her phone. Write the email that accompanies the salon memo (attached). She needs to decide by Friday whether to send Renata an engagement letter for a defamation suit, an IIED suit, or both.

Model answer

Subject: Solís matter: IIED memo attached; recommendation before Friday

Dana,

Bottom line: Renata probably cannot sue Kyle for intentional infliction of emotional distress over the reviews, and an IIED claim over the late-night calls is possible but weak. The memo is attached.

Texas treats IIED as a gap-filler, so a claim whose real subject is reputation is handled as defamation, even if the defamation claim has problems (Zeltwanger, Draker). The calls are separate conduct, but eight hang-ups over two weeks will be hard to call extreme and outrageous.

My recommendation: engage for a defamation claim on the reviews, strengthen the evidence tying the accounts to Kyle, and plead IIED narrowly on the calls only if you want leverage. I can draft the engagement letter for either option by Thursday if you tell me which.

Thank you, Sebastián

Common mistakes

  • Starting with “I hope this email finds you well” instead of the answer.
  • Pasting the memo’s Discussion into the email.
  • Ending without a decision request or a deadline.
